Acceptable Use Policy

Terms

  1. Unless otherwise specified, all definitions used have the same meaning as in the terms of use for the Site, of which this acceptable use policy forms part.
  2. This acceptable use policy sets out the terms between you and us under which you may use the Site. This acceptable use policy applies to all Users of the Site, including Organizations (or their authorized representatives).
  3. Your use of the Site means that you accept, and agree to abide by, all the policies in this acceptable use policy.
  4. We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on the Site.

Use

  1. You may use the Site only for lawful purposes.
  2. You agree not to use, or permit or to allow any party under your control to use the Site:
    • in any way that breaches any applicable local, national or international law or regulation.
    • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
    • for the purpose of harming or attempting to harm minors in any way.
    • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards.
    • to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
    • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  3. You also agree:
    • Not to aggregate, reproduce, duplicate, copy or re-sell any part of the Site or information available from the Site in contravention of the provisions of our terms of use.
    • Not to access without authority, interfere with, damage or disrupt any part of our site, any equipment or network on which the Site is stored, any software used in the provision of the Site or any equipment or network or software owned or used by any third party.
    • If a Registered Talent, not to post on your Talent Profile or in any form of communication facilitated by the Site (such as forums, email, Twitter feeds, blogs and chatrooms):
      • any incomplete, false or inaccurate biographical information or information which is not your own;
      • any advertisement or promotion or perform or encouragement of any commercial activity;
      • any commercial content;
    • If a Registered Talent, not to send private messages with a commercial purpose.
    • Not to sell or transfer your Talent Profile.
    • Not to use the Site or any service provided or facilitated through the Site for any purpose other than:
      • In the case of Registered Talent for the purpose of:
        • creating and maintaining a professional profile of yourself ("Talent Profile") which provides information about yourself, your skills, education, qualifications and other personal information, which will then be shared with Organizations and other Talent or others you connect to via the Site and its services;
        • showcasing your skills, qualifications and experience within your own networks of friends, colleagues as well as educational establishment and Organizations you are following. (nb. Organizations will see the Talent Profiles of all the Talent who are following them);
        • increasing your professional visibility on Google (unless you have made your Talent Profile ‘private’ in your privacy settings);
        • interacting with your other online networks, including using Facebook Connect to import your friends and contacts from Facebook and LinkedIn respectively onto the site;
        • researching, connecting, communicating with and/or following skills, educational establishments and Organization;
        • following, connecting and communicating with other Registered Talent;
        • receiving information about other products and services (including applications and features) which we may make available through the Site from time to time;
        • receiving career and interview advice and Talent Profile / CV preparation;
        • uploading your CV data using the Sites’ CV parsing facility; and
        • reading career or education related content posted on the Site.
      • In the case of an Organization or the authorized graduate recruitment representative for an Organization, for the purposes of;
        • creating and maintaining an Organization profile ("Organization Profile");
        • following, connecting and communicating with Registered Talent;
      • As an educator/university, using the Talent Database for any purpose other than to:
        • identify candidates for courses or graduate and further education programmes;
        • to assess the number of its own undergraduates and graduates who make use of the Site;
        • to promote continued or more use of the Site by its students.
    • Not to send unsolicited mail, email or SMS, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a User or Organization.
    • Not to use any device, software or routine to interfere or attempt to interfere with the proper working of Site or any activity being conducted on the Site.
    • Not to disclose or sharing your Site username or password with any third parties or using your password for any unauthorized purpose.
    • Not to use or attempting to use any engine, software, tool, agent or other device or mechanism including, without limitation, browsers, spiders, robots, avatars or intelligent agents to navigate or search the Site other than the search engine and search agents available from us and other than generally available third party web browsers.
    • Not to attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Site.
    • Not to frame or link to any of the Site content or information available from the Site.
    • Not to advertise to, or solicitation of, any User to buy or sell any products or services through the Site of Services or to use Site content or information obtained through the Site or use of the Services for commercial activities without our prior explicit consent.
    • Not to copy (whether by cut and pasting or manually) or use for personal gain or advantage any element of any other persons' Talent Profile on the basis that this is their personal property.
    • No User shall use their access to the database of Registered Talent ("Talent Database") or database of Organizations ("Organization Database") or content of the Site for any purpose other than as set out in this acceptable use policy.
    • Unless otherwise agreed by us, recruitment businesses or graduate recruitment advertising business or similar ("Third Party Recruitment Businesses") are not permitted to use the Site unless they either do so as an Organization to fulfill their own graduate recruitment needs or on behalf of any Organization by whom they are retained to provide graduate recruitment services and who have themselves registered an Organization Profile with the Site. No other commercial use of the Site and its content is permitted for Third Party Recruitment Businesses.
    • Third Party Recruitment Businesses who register as an Organization to fulfill their own graduate recruitment needs may be required to agree to an additional undertaking as to Site content use as part of the registration process.
    • No User shall use their access to the Site and the information available on the Site to sell, promote, or otherwise deal in any products of services, or to source people to join a franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity.

Content Standards

These content standards apply to any and all material which you contribute to the Site ("Contributions"), and to any interactive services associated with it. You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Contributions must

  • Be accurate and be maintained as accurate (where they state facts);
  • Be genuinely held (where they state opinions);
  • Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not

  • Contain any material which is defamatory of any person;
  • Contain any material which is abusive, threatening, obscene, offensive, hateful or inflammatory;
  • Promote sexually explicit material;
  • Promote terrorism, hatred or violence or the exploitation of people;
  • Promote discrimination based on race, bigotry, sex, religion, nationality, disability, sexual orientation or age;
  • Infringe any copyright, database right or trade mark of any other person;
  • Be likely to deceive any person;
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • Promote any illegal activity;
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
  • Be likely to harass, upset, embarrass, alarm or annoy any other person;
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • Solicit personal information from anyone under 18;
  • Give the impression that they emanate from us, if this is not the case;
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse;
  • Promote physical harm of any kind against any group or individual;
  • Harass or advocate harassment of another person;
  • Contain nudity, violence, or offensive subject matter or contains a link to an adult website;
  • Promote information that you know is false or misleading;
  • Involve the transmission of "junk mail", "chain letters", or unsolicited mass mailing, instant messaging, "spimming", or "spamming";
  • Contain restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
  • Further or promote any criminal activity or enterprise, or provide instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • Solicit passwords or personal identifying information for commercial or unlawful purposes from other Users;
  • Provide any telephone numbers, street addresses, last names, email addresses or other contact or identifying details of any private individual or public figure;
  • Include a photograph of another person that you have posted without that person's consent;
  • Seek information from an individual in relation to his/her racial or ethnic origin, political beliefs, philosophical or religious beliefs, membership of a trade union, physical or mental health, sexual life and sexual orientation, the commission of criminal offenses or proceedings or age (other than to establish they are over the age of 18 years).

You are not allowed to post activities that involve:

  • Criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
  • Covering or obscuring the banner advertisements on your Talent Profile or Organization Profile page, or any Site page via HTML/CSS or any other means;
  • Any automated use of the system, such as using scripts to add friends or send comments or messages;
  • Interfering with, disrupting, or creating an undue burden on the Site (or its services or features) or the networks or services connected to the Site (or its services or features);
  • Attempting to impersonate another User or person;

Interactive Services

  • We may from time to time provide interactive services on our site, including without limitation, chat rooms, forums, wall to wall, bulletin boards ("Interactive services"). Where we do provide any Interactive Service, we will provide information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
  • We will do our best to assess any possible risks for Users from third parties when they use any Interactive Service provided on the Site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on the Site, and we expressly exclude our liability for any loss or damage arising from the use of any Interactive Service by a User in contravention of our Content Standards, whether the service is moderated or not.
  • Where we do moderate an Interactive Service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Suspension and Termination

  • We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of the Site. When a breach of this policy has occurred, we may take such action as we deem appropriate. We reserve the right to investigate and take action against any User who, in our opinion, violates the acceptable use policy.
  • Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use the Site, and may result in our taking all or any of the following actions:
    • Immediate, temporary or permanent withdrawal of your right to use the Site;
    • Immediate, temporary or permanent removal of any posting or material uploaded by you to the Site;
    • Issue of a warning to you;
    • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
    • Further legal action against you;
    • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
